Water Rights and Water Law

The lawyers at CEGR Law that specialize in water law have many years of experience with finding practical solutions to water supply problems. Solutions can vary from contracts for leased water supplies to trades and exchanges that benefit multiple parties. We routinely adjudicate water rights change cases, augmentation plans, water exchange plans, and water storage rights in most of the seven water courts in Colorado. Our professional staff knows the geography and hydrology of Colorado, and the complex interrelationships among state and federal agencies, nonprofit stakeholders, public water rights users, ditch and reservoir companies, utilities, and private water rights users. Our clients include nonprofit water companies, municipalities, special districts, miners, farmers, and recreational water users.

We are adept at finding negotiated resolution of contested water issues among the stakeholder parties. Our lawyers are equally comfortable in water court adjudications, mediations, agency administrative proceedings, and meetings of stakeholders. Our water lawyers have engineering decrees in addition to law degrees, or advanced legal degrees with emphasis on water resources law. We actively participate in developing legislation and advocating in appellate courts for reasonable and necessary changes or adaptations of Colorado’s water law. We enjoy the practice of water law and water policy, which we find benefits our clients.

We have drafted or advised on appropriate rules and regulations, rate-setting procedures and rate analyses, service standards and specifications, and policies for our water and sanitation service clients. Our lawyers have employed complex agreements and water plans to achieve efficient cost-effective solutions for getting Colorado water to the locations where it can be used by our clients. We often also assist with financing and contracting necessary for constructing infrastructure for raw water capture and storage, water treatment, municipal water distribution, wastewater treatment, and the real property interests and permitting necessary for such infrastructure. Adequate and reliable water resources are essential to our clients, and in Colorado, reliable water sources are sometimes challenging to acquire. We provide the expertise to overcome the challenges.
